[01] USER_OBLIGATIONS

By using Cognitive Nest services, you agree to the terms outlined below. These terms govern your use of our website, platforms, and IT services.

  • You are responsible for maintaining the confidentiality of your account credentials and access information.
  • Unauthorized security testing or scanning of Cognitive Nest systems is prohibited without written consent.
  • Service usage must remain within the scope of your agreement. Excessive or abusive usage may result in throttling or suspension.

[02] SERVICE_SCOPE

Cognitive Nest provides IT infrastructure, managed services, and consulting on the terms agreed in your service contract. Uptime targets of 99.9% apply to managed environments, excluding scheduled maintenance windows.

[03] INTELLECTUAL_PROPERTY

All intellectual property — including software, documentation, network designs, and proprietary tools — remains the exclusive property of Cognitive Nest IT Services Co. unless explicitly transferred in writing.

[04] LIABILITY

Cognitive Nest shall not be liable for any indirect, incidental, or consequential damages arising from service interruptions, third-party failures, or circumstances beyond our reasonable control.

  • Cognitive Nest reserves the right to suspend services to any client whose usage threatens system integrity or violates these terms.
  • Force Majeure events include natural disasters, government actions, utility failures, and other circumstances beyond reasonable control.
CRITICAL_NOTICE:

THE AGGREGATE LIABILITY OF COGNITIVE NEST FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY THE CLIENT DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE INCIDENT.
